Samsung, Broadway Photo Settle

Samsung Electronics said Wednesday that it has settled a lawsuit that resulted from its action last year against a New York company that it said violated its retail policy.

Samsung Electronics said Wednesday that it has settled a lawsuit that resulted from its action last year against a New York company that it said violated its retail policy.

Samsung had sued Broadway Photo in July of 2008 for trademark infringement, after the company marketed and sold Samsung's products in a way that Samsung claimed violated its trademarks. Under terms of the settlement, Broadway Photo agreed to avoid using Samsung’s product pictures or descriptions in selling Samsung’s products, and will accurately disclose applicability of Samsung’s manufacturer’s warranty for sales on its Web site.

“Samsung greatly values the strong relationship it has with its network of authorized dealers and resellers that help ensure consumers receive excellent customer service,” Tim Baxter, president of Consumer Electronics Division of Samsung Electronics America, said in a statement.

“We will continue to be vigorous in protecting our authorized partners, our brand and products and addressing the actions of unauthorized dealers. Enforcement also helps us better serve consumers that run the risk of buying a product from an unauthorized dealer that may have been altered, used or refurbished and not protected by warranty.”
