Vizio Shipments Not Affected by ITC Battle

While the U.S. International Trade Commission has placed a limited exclusion order on Vizio, in relation to its patent battle with Funai, Vizio will continue to both import and ship its products during the present presidential review period, the company said in a statement over the weekend.

The ban on importing of the TVs is scheduled to go into effect in 60 days, and could be overturned by either the president or a federal appeals court. The disputed patent involves the way digital TV receivers identify programs and channels.

"While we appeal the ITC ruling with the Federal Circuit's U.S. Court of Appeals, we will continue to offer American's the best performance TVs at the best values," the company's cofounder, Laynie Newsome, said as part of the announcement.

"Even though we are committed to our policy to respect the rights of intellectual property holders, we will continue to thoroughly investigate all claims, and vigorously defend our legal rights when we feel a claim is invalid or not infringed."
